The Trump position further argues that a president or former president can only be charged with a crime after successfully being impeached. If this were the standard, then a president could have members of the senate assassinated before they could rule on impeachment. He would get away with it because those who would rule in favor of the impeachment would be dead. I will be very surprised if Trump's view on presidential immunity prevails, but it is instructive that this is the way Trump thinks. |
