Len Silverman to Challenge Cortney Rogers for seat formerly held by Debra Maggart

Len Silverman of Hendersonville has announced he is running in the Republican primary for the 45th district State House of Representatives seat. He is challenging incumbent State Representative Courtney Rogers.

Rogers defeated Representative Debra Maggart, who was the Republican whip in the House, in the 2012 Republican primary in a bitter campaign focused on extending gun rights. The Tennessee Firearms Association did not deem Republican Debra Maggart sufficiently pro-gun and they spend an unprecedented $155,000 plus dollars in negative campaigning and disparaged her A+ rated, pro-Second Amendment voting record.  They said she was for gun control, for shredding the Constitution, and compared her to President Barack Obama. That campaign got national attention and was used as an example of the power of the gun lobby.

Until last month there was speculation that Maggart might seek a rematch and challenge Rogers in the 2014 primary. In mid-November however, she announced she would join a Nashville lobbying firm ending that speculation.


Silverman  owns a Huntington Learning Center tutoring franchise in Hendersonville. He is Chairman of the  Board of Directors for COMPASS, a foundation that helps raise funds for Sumner County Schools.  Until recently, COMPASS was headed-up by former State Representative Debra Maggart.

He is also Chairman of the Hendersonville Chamber of Commerce and the Chamber Foundation, Chairman of the Sumner County United Way, and a member of the Board of Trustees of Pope John Paul II High School.

I thought the piece was very well done and I am sure it will enrage some acolytes of the gun lobby.   The mother of the little boy named Noah who was killed at Sandy Hook Elementary is of course,  heartbreaking.

Debra Maggart is a life time member of the NRA and always supported its agenda, even voting for a bill that allowed guns in bars. But in 2012 she refused to support a bill that would have allowed Tennesseans to keep guns inside their locked cars, because she thought it was dangerous. She says that as a result, the NRA turned on her, making sure she was defeated in the 2012 primaries.

Thoughts about guns-in-trunks and property rights

While I have been critical of the proposed "guns-in-trunks" legislation, I would like to clarify my position. I am not as opposed to the actual legislation as I am the way it has been presented and pushed. The bill will soon come to a vote and undoubtedly it will pass. If I were in the State legislature and my constituents had lobbied me to support this bill, I would most likely vote for it also, so I am not critical of those who are going to vote for the proposal.

I have been critical of the argument that when an employer or other private property owner prohibits you from carrying a gun on to his property that is somehow a violation of your Second Amendment rights. It is not. That is no more a violation of your Second Amendment rights than if The Tennessean chooses not to print your letter-to-the-editor is a violation of your freedom of the speech rights guaranteed in the First Amendment. If a shopping mall owner says you may not distribute the Watchtower in his shopping mall parking lot, that is not a violation of your freedom of speech rights or your freedom of religion rights guaranteed by the First Amendment. All of our constitutional rights are protections against government, not restrictions on our fellow citizens. Forcing someone to allow guns on their property is a violation of private property rights. It is a taking of another's rights to their property.

My second criticism is the way the gun lobby used raw political power and bullied those who would not bend to their will. Because former chair of the Republican caucus Debra Maggart, a solid conservative and herself an advocate of second amendment rights and an NRA member and gun owner, would not push the bill through last session the gun lobby slandered her and threw massive amounts of money into her campaign in an effort to defeat her and they were successful. I find that highly offensive. I find such raw political power frightening. I don't like bullies.

If I think that taking away the right of a property owner to determine who may bring a weapon onto his property is an infringement on his property rights, then how can I now say I would most likely support it? Our rights are not absolute. We already accept many restrictions on our private property rights. Zoning says you cannot operate a garbage dump in a residential neighborhood. At one time many of this questions of how far you could go in using your property that distracted from your neighbors enjoyment of his property was a matter of common law, but now we have codified these laws.

We accept that you cannot raise pigs in a residential community. Here in Nashville, you may now raise chickens but the number is limited and you must get a permit. We accept that that is a grant from government, not a right. We accept that the government can tell you how much of your lot can be occupied by your structure and how tall you can build it and that you cannot park on the grass in your own yard. While we accept many zoning laws and building codes that restrict what we can do with our property, if a private property owner is operating a business, we accept even more restrictions. There are many ways in which we tell the owner of a business not only what he may not do, but what he must do. We accept that the government tells you how many parking spaces you must have based on the type of business you have. A real estate office does not have to have as many parking spaces as a restaurant. Businesses must make reasonable efforts to accommodate the handicapped. If your sale alcohol you must stop serving by 2 AM. We already accept many restrictions on the rights of property owners.

I only barely remember it, but I remember the civil rights movements when Blacks could not go to movie theaters or eat in restaurants or stay in motels. Most people in the South thought that was perfectly OK. The effort to require that owners of businesses serving the public accommodate anyone regardless of color or race was met with strong opposition. Sure, some of it, maybe most of it, was based on bigotry, but there were those who made a principled argument that for the government to require a restaurant to serve people the owner did not want to serve was an infringement on the property rights of the owner.

Most recently we have seen government requiring most eating and drinking establishments to ban smoking. I myself miss smoke-filled bars and enjoy smoking while drinking. I think that was a government over reach and think each establishment should get to decide their own policy. On the other hand, I support an end to "whites only" policies although I accept that both are infringements on the rights of property owners.

How do I square this circle? One does not have to be consistent. Rights are not absolute and sometimes policies are judgment calls decided by the political process. Let us go back to what I said earlier, that if a shopping mall owner prohibits you from distributing the watchtower on his property, your First Amendment rights have not been violated. You have no right to proselytize on the property of another. If I was a legislator, I would not support legislation saying a mall owner must let you distribute religious tracts on his property. Now, consider a mall owner who said you were not permitted to have a Bible in the glove compartment of your car while in the parking lot of his mall. That is still not a violation of your First Amendment rights, however I would support legislation saying mall owners could not impose such restrictions.

By JOE PALAZZOLO,WSJ, Nov. 30th, 2012- Gun legislation in some Southern states is forcing Republican lawmakers to choose between two core values of their party: the right of business owners to control what happens on their property and people's Second Amendment right to bear arms.

When Republican Debra Maggart, a staunch supporter of the gun group over her seven-year career in the Tennessee House of Representatives, decided with other members of her party to hold up a parking-lot bill introduced by Democratic Rep. Eddie Bass this year, she felt the consequences. The NRA spent tens of thousands of dollars on attack ads against Ms. Maggart, the only member of Republican leadership to face a primary challenge. One NRA flier declared: "Debra Maggart wants to shred your Second Amendment rights."

Ms. Maggart said she opposed the bill because it encompassed properties such as day-care centers and colleges. "They singled me out to bully our caucus into voting for a poorly written piece of legislation."

Ms. Maggart, a lifelong NRA member who owns a Remington shotgun, ultimately lost to the NRA-backed candidate by 971 votes in the primaries in August.

...Frank Niceley, a Strawberry Plains Republican who moved from the House to the Senate in this month’s elections. Niceley said he’s hesitant to go along with Republican Senate Speaker Ron Ramsey’s call to quickly pass a compromise on the gun bill and move on to other issues.

“If we allow them to come in here and pass a bill right off the bat, we’re telling the other lobbyists the way to get things done is through fear and intimidation,” he said.

 Niceley said he would allow employees to store weapons in their cars if he owned a factory, but that such decisions should be left to each business.

“If a property owner tells someone you can’t bring a yo-yo on your property —much less a gun — you can’t bring it on that property,” he said.  

My Commentary

I agree with Nicely.

After the defeat of Debra Maggart at the hands of the NRA, the gun lobby has shown that no one is safe if they dare cross them. Still, the legislature should not buckle to the radical fringe on a matter of principle . At some point in the past, the NRA stood for the constitutional right to bear arms. No more. Now, they want gun owners to have rights that are not protected by the constitution. Now, they want to impose their will on others and trample the property rights of others.

The NRA is not a pro-second amendment lobby anymore; they are a gun rights lobby. There is a difference. The second amendment protects our right to bear arms from government infringement. The second amendment is a protection against government, not your neighbor who does not want guns on his property. To argue that the right to carry a gun onto your employer's property is a second amendment issue is equivalent to arguing that to compel the Tennessean to publish your letter to the editor is a first amendment issue.

Nevertheless,  It seems that there should be some way around this issue, without trampling private property rights and extending gun rights beyond those protected by the constitution. I would like to see what Ramsey's compromise looks like. If your gun is concealed in the trunk of your car, how would an employer ever know? They are not going to do a detailed search of every car entering their parking lot. It is impractical.

Does one's employer have the right to search an employee's private vehicle when it is driven onto his parking lot. As a condition of employment, if one gives his employer the right to search his car such as by initialing a policy statement, then the employer may have the right to search an employee's car.  Otherwise it is questionable. The website Findlaw says, "If it's your personal car, then probably not. If your employer believes that you have dangerous or illegal materials in your car, they should call the police rather than searching the car themselves."

If an employer has that right, should he?  Should he be permitted to force you to give up an expectation of privacy as a condition of employment? I do recognize that rights may at times be in conflict and few rights are absolute.  I do not think that an employer should be allowed to force you to surrender all of your rights as a condition's of employment. I object to a policy that says you can be subject to random drug test by your employer. Maybe for school bus drivers or airline pilots or some professions engaged in dangerous work, that may be reasonable, but not for most people. Yet, many employers, as a condition of employment, have employees agree to a policy that says they are subject to random drug test. That seems more of an invasion of my privacy than a search of my vehicle.

Rather than expanding the right of gun owners to carry a gun onto the property of another, maybe we need to examine what expectation of privacy an employee should have. What right does an employer have to determine if you are or are not storing a gun in your car?  Could an employer not maintain the right to prohibit guns on his property, yet have some sort of don't ask-don't tell policy about who has a gun in his car.  And should not an employee have a reasonable expectation that his car is not subject to search by his employer?

Rod's comment: Wow! I am overwhelmed! Great speech. Emotional! A great convention. I am so pumped up. At the conclusion, I stood up in my bedroom and applauded. For the sake of our nation, for the future of the idea of liberty, for the concept that a people can govern themselves, we must win this next election. I honestly believe there has never been a more important election facing this country than this one. Will we go down the path of dependency and bankruptcy and mediocrity or will we embrace the vision that has made America a unique nation among nations? America is more than a country; it is an idea. Do the American people have what it takes to hold on to it?

Rod's Comment: I was pleased to see Craig Romney speak in Spanish although I could not understand it. I was pleased to see the clip recognizing all of the Hispanic Senators, Governors and other Hispanic elected officials. I know there is a tiny "English-only" xenophobic segment of the Party, but it is a small segment. I think most Republicans welcome those who share our values, regardless of their native language or country of origin. 

Craig Romney doesn't have to emote or conjure up passion. Authentic.

Hope has left the Democratic Building. It's palpable in Tampa+across nation thru GOP Convention. Now, Change just has to catch up!

A Big night in Tampa! Report # 8


MSNBC Meltdown, Shambles, Nationlistic, Blinded, Crazed. Really embarrasses a previously respected vocation, journalism.

Paul Ryan not only knocked it over the fence, he put it through the windshield of the Obama bus!

"Two of Your faithful sons" describes the Orthodox Priest of Romney & Ryan. Amen.

Rod's comment: I am not in Tampa, but am glued to the TV watching the convention gravel-to-gravel and enjoying it immensely. I am watching it on C-span uninterrupted by commentary except for switching channels during musical interludes and long applause segment and then am catching a little on Fox, MSNBC and CNN. I think it is better to watch it unfiltered.

I have the utmost respect for John McCain and wish he was our President, however when John McCain essentially urged military intervention in Syria, he lost me. I am not so sure that the opponents of the Syrian regime would be preferable to the current Syrian regime. Also, foreign wars can be easy to get into and very hard to get out of. The last thing we need to do is to get bogged down in another war. We are a war-weary nation with no appetite for another war.At the same time, we must not abandon our leadership roll in the world.

Apparently Mitch McConnell's main job was to separate the Ron Paul tribute from Rand Paul's speech. Hence he took the air out of the room.

Turns out Ted Nugent was not the only Republican in Damn Yankees. Someone named Jack Blades is now performing.

McConnell is making a fairly good speech against Obama, but with his dry delivery, I see why they gave him this slot.
